UNIVERSAL TEAM LIABILITY WAIVER, RELEASE OF CLAIMS, ASSUMPTION OF RISK & INDEMNIFICATION AGREEMENT

This Liability Waiver and Release of Claims Agreement (“Agreement”) is entered into by and between The Yard Performance Center, LLC, a private training facility located in Farmington, New Mexico (“Facility”), and the undersigned Participant and Parent/Legal Guardian (if Participant is under 18).

This Agreement applies to all teams, clubs, schools, travel organizations, and independent athletes utilizing the Facility.

1. TEAM & PARTICIPANT INFORMATION

2. DESCRIPTION OF FACILITY & ACTIVITIES

I understand that The Yard Performance Center is a private baseball and athletic

performance training facility that may include, but is not limited to:

 Batting cages

 Pitching lanes

 Pitching machines

 Turf training areas

 Strength & conditioning equipment

 Free weights

 Resistance machines

 Agility & speed equipment

 Throwing programs

 Team practices

 Private lessons

 Camps, clinics, and tournaments

 Any related athletic or training activity

3. ASSUMPTION OF INHERENT RISK

I understand that participation in baseball, strength training, conditioning, and athletic

performance training involves inherent risks including, but not limited to:

 Being struck by baseballs, bats, or training equipment

 Collisions with other participants

 Slipping, tripping, or falling

 Muscle strains, tears, or pulls

 Shoulder and elbow injuries

 ACL and ligament injuries

 Concussions

 Broken bones

 Back injuries

 Heat-related illness

 Equipment malfunction

 Permanent disability

 Death

I voluntarily and knowingly assume all risks, both known and unknown, even if arising

from the negligence of the Facility.

4. RELEASE OF LIABILITY

In consideration for being permitted to enter and use the Facility, I hereby RELEASE,

WAIVE, DISCHARGE, AND COVENANT NOT TO SUE:

 The Yard Performance Center, LLC

 Its owners

 Employees

 Coaches

 Trainers

 Volunteers

 Independent contractors

 Representatives

from any and all liability, claims, demands, actions, or causes of action arising from:

 Personal injury

 Illness

 Property damage

 Loss

 Death

including claims based on ordinary negligence.

5. MEDICAL CERTIFICATION & AUTHORIZATION

I certify that the Participant is physically able to participate in athletic training activities.

Known medical conditions (if any):

I authorize The Yard Performance Center to:

 Provide basic first aid

 Contact emergency medical services

 Arrange transportation for emergency treatment

I accept full financial responsibility for any medical expenses incurred.

6. INDEPENDENT STATUS OF FACILITY

I understand and acknowledge:

 The Yard Performance Center is a private business.

 It is not affiliated with any specific school, league, or organization unless

separately contracted.

 Teams and coaches using the Facility do so independently.

7. INDEMNIFICATION

I agree to indemnify and hold harmless The Yard Performance Center and its

representatives from any claims, damages, legal fees, or expenses arising from

participation at the Facility.

8. FACILITY RULES & CODE OF CONDUCT

Participant agrees to:

 Follow all posted rules

 Follow staff instructions

 Use equipment only as intended

 Wear proper athletic attire

 Refrain from horseplay

 Report unsafe conditions

The Facility reserves the right to remove any participant for unsafe or inappropriate

behavior.

9. DAMAGE TO PROPERTY

Participant and/or Parent/Guardian agrees to be financially responsible for any

intentional or negligent damage to Facility property or equipment.

10. PHOTO & VIDEO RELEASE (Optional – Check One)

11. SEVERABILITY

If any portion of this Agreement is deemed unenforceable, the remaining provisions

shall remain in full force and effect.

12. GOVERNING LAW

This Agreement shall be governed by the laws of the State of New Mexico.

13. ACKNOWLEDGMENT & SIGNATURES

I certify that:

 I have read this Agreement carefully.

 I fully understand its contents.

 I understand I am waiving substantial legal rights.

 I sign voluntarily and without coercion.
